Platform Terms of Use

These Terms govern access to and use of 360 Propertii Realty, belonging to 360 Propertii Realty Limited, including listings, offers, communications, transaction administration, and securely held payments.

Platform Terms of Use

1. Introduction and acceptance

These Terms govern access to and use of 360 Propertii Realty belonging to 360 Propertii Realty Limited, including its website, property-search functions, accounts, listings, advertisements, views, offer tools, communications, transaction administration and securely held payment services. By creating an account or using any account-based function, the user confirms that the user has read, understood and agreed to these Terms and the policies incorporated in this document.

A person who does not agree may browse publicly available property information but must not register, advertise, submit an offer, accept an offer, make a payment or use any transaction service.

2. Definitions

“Advertising User” means an individual, owner, landlord, direct seller, estate or letting agent, developer, business or authorised representative that submits or publishes a property advertisement. “Purchaser” includes a prospective buyer, tenant or other registered person submitting an offer. “Transaction Price” means the total price, premium, rent or other principal consideration accepted for the transaction, excluding taxes and charges expressly stated to be separate. “Completion” occurs when the applicable completion conditions have been satisfied or waived and the escrow provider is lawfully authorised to release the transaction funds. “Escrow Provider” means the licensed bank, payment service provider, regulated escrow facility or duly appointed stakeholder identified in the transaction flow.

3. Public access and registration

Property listings may be viewed without registration. Registration is required to advertise property, submit or accept an offer, transact, receive account-based communications or use payment functions. A user must provide a valid email address, telephone number, correct user category and all identity, authority, business or transaction information reasonably required by 360 Propertii Realty.

  • A user must be legally capable of entering the contemplated transaction.
  • All registration information must be complete, accurate and kept current.
  • An agent or representative must identify the principal and provide satisfactory authority.
  • A business or developer must provide relevant registration, beneficial ownership and authorised-person information.
  • Each user is responsible for protecting account credentials and immediately reporting suspected compromise.

4. Advertisements and administrative approval

No advertisement is published automatically. Every advertisement is subject to administrative review. 360 Propertii Realty may approve, reject, return for amendment, suspend, restrict, label or remove an advertisement where information is incomplete, misleading, unlawful, duplicated, disputed, unauthorised, unsafe or inconsistent with the platform’s standards.

Administrative approval permits publication only. It is not confirmation of ownership, authority, title, survey boundaries, value, physical condition, availability, planning compliance or freedom from encumbrances. Users must conduct independent inspections and professional due diligence.

5. Views, offers and acceptance

Listing views and engagement figures are indicative platform records and are not promises of enquiries or completion. A registered Purchaser may submit an offer through the offer function, stating the proposed price, validity period, conditions and other requested information.

360 Propertii Realty may review an offer for completeness, identity, payment readiness, fraud indicators and compliance before communicating it to the Advertising User. Administrative approval of an offer only authorises communication; it does not amount to acceptance and does not bind the Advertising User. An offer becomes accepted only when the Advertising User accepts through the approved workflow or signs the applicable transaction document.

6. Agency Fee

Completion of a transaction arising from a listing, view, enquiry, offer, lead or introduction made through 360 Propertii Realty entitles 360 Propertii Realty to an Agency Fee equal to 3% of the Transaction Price, together with applicable tax where lawfully chargeable. The parties authorise the Escrow Provider to deduct the Agency Fee and properly disclosed provider charges before releasing the net balance to the Advertising User or other lawful payee.

A user must not divert, conceal or complete a transaction outside the platform to avoid the Agency Fee. The fee remains payable where the transaction is concluded with a person introduced through the platform within twelve months after the relevant listing, offer, enquiry or introduction.

7. Cancellation Fee

Where an accepted transaction is cancelled because a party unilaterally withdraws, repudiates, fails to pay, fails to provide required documents, refuses to complete or otherwise defaults, the defaulting or withdrawing party shall pay 360 Propertii Realty a Cancellation Fee equal to 3% of the Transaction Price. The fee may be deducted from money otherwise refundable to that party only where authorised by the escrow mandate and applicable law.

The Cancellation Fee will not ordinarily apply where the parties mutually cancel before material transaction work and 360 Propertii Realty agrees; a condition precedent fails without fault; the Advertising User lacks or materially misrepresents title or authority; the transaction becomes unlawful; 360 Propertii Realty or the Escrow Provider cannot lawfully proceed; or mandatory law requires a refund without the fee.

8. Secure payments and safeguarding

Purchase funds must be paid only through the authenticated transaction flow into the segregated escrow or safeguarded payment arrangement identified for the transaction. Transaction funds are not the operating money or beneficial property of 360 Propertii Realty and must not be commingled, pledged, invested or applied to its expenses.

Funds will be released only after the transaction-specific completion conditions and authenticated release instructions have been satisfied. These may include identity and authority checks, executed transaction documents, agreed title-search outcome, satisfaction of conditions precedent, possession or handover confirmation and other evidence stated before payment.

9. Refunds and disputed funds

An approved refund will be returned to the original lawful funding source, less only amounts properly disclosed and legally deductible, ordinarily within ten business days after the Escrow Provider receives complete instructions and compliance clearance. A refund may be delayed by chargeback, investigation, court order, sanctions, anti-money-laundering or source-of-funds requirements.

Where entitlement to funds or responsibility for cancellation is disputed, the disputed amount may remain held until the parties reach a written settlement or a court, arbitral tribunal or other competent authority gives a binding direction. An administrator does not finally determine title or confiscate disputed funds.

10. User warranties

  • The user has legal capacity and authority for every registration, listing, offer, acceptance and instruction.
  • All information, documents, descriptions, photographs, prices, fees and representations supplied are accurate and not misleading.
  • The user owns or has permission to use uploaded content and personal information.
  • The property and proposed transaction are lawful and are not subject to an undisclosed dispute, restriction or adverse interest.
  • Funds are from lawful sources and the user will comply with identity, beneficial ownership and source-of-funds requirements.
  • The user will not impersonate another person, manipulate offers or views, divert payments, submit forged documents or circumvent platform fees.

11. Platform role and limitations

360 Propertii Realty provides property advertising, introductions, offer routing, transaction administration and escrow coordination. Unless expressly stated in a separate written engagement, it does not provide a legal opinion, survey, valuation, structural inspection, mortgage approval, investment advice or guarantee of ownership, title, identity, availability, price, condition or completion.

Property transactions involve material risks. Every user should inspect the property, verify the counterparty and obtain independent legal, survey, valuation, planning, financial and technical advice appropriate to the transaction.

12. Suspension and termination

360 Propertii Realty may warn a user, remove content, limit functionality, place a transaction or release under review, suspend or terminate an account, preserve evidence and cooperate with lawful authorities where fraud, impersonation, unauthorised listing, security risk, payment abuse, regulatory concern or material breach is reasonably suspected. Where appropriate and lawful, the affected user will be informed and allowed to submit a complaint or appeal.

13. Indemnity and liability

A user is responsible for losses caused by that user’s breach, unauthorised acts, false or misleading information, unlawful content, misuse of personal data, defective authority, fraud or fee circumvention. The user shall indemnify 360 Propertii Realty against resulting third-party claims, regulatory costs and reasonable professional expenses, subject to applicable law, causation and mitigation.

Nothing in these Terms excludes liability that cannot lawfully be excluded. Subject to that qualification, 360 Propertii Realty is not liable for an independent user’s acts, property defects, title defects, failed financing, off-platform payments, unauthorised communications, indirect loss or loss caused by events reasonably beyond its control.

14. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. A complaint must first be submitted through the Contact Us facility. The parties shall attempt good-faith resolution for fourteen days. If resolution fails, either party may pursue mediation, arbitration where separately agreed, or proceedings before a court of competent jurisdiction in Lagos State, without preventing urgent protective or regulatory relief.

15. Changes and contact

360 Propertii Realty may update these Terms and policies to reflect legal, security, operational or product changes. Material changes will be communicated through the platform and will take effect from the stated date. Questions, complaints, privacy requests and formal notices may be submitted through the Contact Us facility on the portal.

Public Legal Policies

The following policies form part of the terms governing use of 360 Propertii Realty. Where a transaction-specific order or signed agreement imposes additional terms, both apply. If there is an inconsistency, mandatory law prevails, followed by the transaction-specific agreement for that transaction and then these general policies.

8. Retention

Data is retained only for the period reasonably required for the stated purposes, contractual limitation periods, fraud prevention, dispute resolution, tax/accounting and legal obligations. Verification and transaction records may be retained longer than ordinary marketing data. Data will then be securely deleted, anonymised or archived under restricted access.

No system is completely secure; users must protect credentials and report suspected compromise promptly.

11. Children, changes and contact

The service is intended for adults legally capable of property transactions. Material changes will be notified through the Portal or other appropriate means. Privacy requests should be sent to the Contact Us facility. Identity verification may be required before a request is actioned.

Cookie Policy

Public browsing and account technologies

Public visitors may receive strictly necessary and consent-managed cookies. Account, offer and escrow functions may require authentication, security, fraud-prevention and session technologies. Non-essential analytics and advertising technologies should follow the published consent architecture.

1. Purpose

This Policy explains how 360 Propertii Realty uses cookies, software development kits, pixels, local storage and similar technologies. It should be read with the Privacy Policy.

2. Categories

  • Strictly necessary: authentication, security, load balancing, consent records and essential transaction functionality.
  • Preferences: language, location, display and saved-search settings.
  • Analytics: aggregated or pseudonymous measurement of traffic, errors and feature use.
  • Advertising: audience measurement, campaign attribution, frequency control and interest-based advertising, only where lawfully activated.
  • Third-party content: maps, video, chat or social features that may set their own technologies.

5. Updates and contact

This Policy may be updated when technologies or providers change. The effective date must be shown and material consent changes must be presented again. Questions may be sent to the Contact Us facility.

Property Listing and Advertisement Policy

Registration and administrative approval

Only a registered user may advertise. Registration and submission do not create a right to publication. 360 Propertii Realty may verify identity/category information, request supporting evidence, approve or reject an advertisement, require correction, limit visibility, suspend or remove the listing. Approval only confirms compliance with the Portal’s publication process at that time; it does not authenticate title or guarantee the transaction.

Advertiser categories

The user must select and accurately maintain the capacity in which it acts: individual owner/landlord; direct seller; estate or letting agent; developer; incorporated or unincorporated business; or other approved category. An agent or representative must supply a valid mandate from the principal.

1. Eligibility and authority

Only a person with legal capacity and demonstrable authority may publish a listing. An owner must establish identity and a reasonable basis of ownership. An agent, developer, landlord representative or company officer must provide written authority and relevant registration or professional information. Acceptance of a listing is not recognition of title.

2. Mandatory listing information

  • accurate property type, location, price/rent, tenure, size and material features;
  • identity and capacity of the advertiser and, where different, the owner or principal;
  • material fees, agency commission, service charges, taxes, deposits and recurring costs;
  • current availability and any material restriction, encumbrance, dispute, occupation or adverse interest known to the advertiser;
  • true, current photographs and plans that fairly represent the property; and
  • the verification status actually awarded by the Portal, without embellishment.

3. Prohibited listings

  • property the advertiser has no authority to market;
  • false, misleading, bait, duplicate, unavailable or unlawfully discriminatory listings;
  • misstated location, price, dimensions, title, approvals, condition or amenities;
  • stolen photographs, personal data or third-party intellectual property;
  • requests for off-platform advance payments designed to evade safeguards;
  • property or transactions prohibited by law, court order or regulatory direction; and
  • malware, hidden advertising, scraping instructions or unrelated content.

4. Advertiser declarations

On every submission and material amendment, the advertiser declares that the information is complete and accurate, authority remains valid, all required consents have been obtained, the listing complies with law and this Policy, and changes in price, availability, authority, dispute or title status will be reported immediately.

5. Review, ranking and moderation

The Portal may request evidence, edit formatting without changing substance, refuse publication, reduce visibility, label, suspend or remove a listing. Ranking may consider relevance, location, recency, completeness, user preferences, paid promotion and compliance history. Paid placement must be identifiable.

6. Inspection and verification

A listing may be published without inspection or title investigation unless a specific badge expressly says otherwise. “Documents submitted” means only that specified documents were received and subjected to the stated review; it is not a guarantee of authenticity, ownership, good title or absence of encumbrances.

7. Complaints and records

Users may report a listing through the stated channel. The Portal may preserve the listing, account, communications and verification evidence; seek a response; restrict the account; notify affected users; and cooperate with authorities. Malicious reports are prohibited.

Registered User and Advertiser Terms

Application to all registered transaction users

These Terms apply not only to professional listers but also to individual advertisers, direct sellers, landlords, agents, developers, businesses, buyers and prospective purchasers. Each user warrants capacity, accurate registration details and authority for every listing, offer, acceptance and payment instruction.

Agency-fee undertaking

Every Advertising User and offering purchaser acknowledges that Completion through or arising from a Portal introduction entitles the Portal to the 3% Agency Fee. The parties irrevocably authorise deduction from escrow. Completing off-platform to avoid the fee does not extinguish the fee where the transaction arose from a Portal listing, view, lead, offer or introduction during the stated tail period.

Cancellation-fee undertaking

A party that withdraws or defaults after an offer becomes accepted and thereby causes cancellation is liable for the 3% Cancellation Fee, unless Part 10 or the transaction order provides an exception.

1. Application and relationship

These Terms apply to every professional or repeat property lister using 360 Propertii Realty. They supplement the general Website Terms. The lister acts as an independent party and has no authority to bind 360 Propertii Realty unless a separate written mandate expressly provides otherwise.

2. Onboarding

  • Provide accurate identity, CAC, beneficial ownership, contact, professional or regulatory and bank/payment information requested.
  • Provide owner mandates, development rights or landlord authority for each listing.
  • Maintain licences, registrations, tax status, insurance and statutory records applicable to the lister’s activities.
  • Notify the Portal promptly of changes, investigations, sanctions, insolvency, disputes or loss of authority.

3. Core warranties

The lister warrants continuing capacity and authority; accuracy and completeness of all representations; lawful rights to uploaded content; compliance with consumer, property, advertising, privacy and anti-fraud law; and that no payment request or transaction will be structured to mislead a user or evade Portal controls.

4. Fees and commercial terms

Listing, subscription, promotion, referral or transaction fees must be stated in the applicable order form or plan. Unless expressly stated, fees exclude applicable taxes. The Portal may suspend paid features for non-payment. A commission arises only on the trigger expressly identified in a separate brokerage or referral schedule.

5. Leads and user data

Lead information may be used only to respond to the relevant property enquiry, comply with law and conclude the contemplated transaction. It must not be sold, scraped, used for unrelated marketing without lawful permission, or retained indefinitely. The lister is independently responsible for its privacy notices and security.

6. Transaction conduct

  • Do not collect or redirect money contrary to the approved payment flow.
  • Issue required receipts and disclose all fees and recipients before payment.
  • Do not represent Portal verification as a guarantee or substitute for independent legal due diligence.
  • Promptly update availability and disclose material developments.
  • Cooperate with complaints, refunds, fraud reviews and evidence requests.

7. Suspension and termination

The Portal may immediately restrict a listing or account where fraud, impersonation, unauthorised listing, regulatory risk, security risk, repeated complaint, payment abuse or material breach is reasonably suspected. Where safe and lawful, reasons and an appeal channel will be provided. Accrued payment, confidentiality, data, indemnity and dispute provisions survive termination.

8. Indemnity and liability

The lister indemnifies the Company against third-party claims, losses, regulatory costs and reasonable professional expenses arising from the lister’s breach, unauthorised listing, misleading representation, unlawful content, misuse of personal data or transaction conduct, subject to applicable law and appropriate causation and mitigation principles.

Verification and Due-Diligence Policy

Effect of admin approval

Approval of an advertisement or offer is not a “verified title” decision. Unless a separate badge expressly states otherwise, the administrator checks platform eligibility, completeness and apparent consistency only. Buyers must conduct independent legal due diligence before funds are released.

1. Principle

Verification labels are limited statements of the checks actually performed. They are not guarantees, insurance, valuation, legal opinions or promises that a transaction is safe. Users should obtain independent legal, survey, valuation, planning and physical-condition advice before committing funds.

2. Approved status labels

  • Identity Checked: stated identity evidence was reviewed using the process current on the verification date.
  • Business/Professional Details Checked: specified registration or credential information was reviewed; continuing good standing is not guaranteed.
  • Documents Submitted: named property documents were received; authenticity, validity and legal effect are not confirmed.
  • Authority Evidence Submitted: a mandate or authority document was received; it is not a determination that the principal owns good title.
  • Property Location Confirmed: location or existence was observed through the stated method; boundaries, condition and title are not verified.

3. Matters not covered

Unless a separate written report expressly states otherwise, the Portal does not verify ownership, root of title, authenticity, survey coordinates, acquisition/revocation, encumbrances, litigation, probate, planning approval, building approval, physical defects, vacant possession, tax, price, solvency or ability to complete.

4. Process

  • Collect prescribed identity, business, authority and property-document evidence.
  • Check completeness, consistency, validity indicators and available trusted sources proportionate to the selected status.
  • Record reviewer, method, evidence category, date, result, qualifications and expiry.
  • Escalate discrepancies; request clarification; refuse or downgrade where evidence is insufficient.
  • Display the exact status, verification date, expiry and clickable limitations beside the badge.

5. Duration, monitoring and withdrawal

A status expires after twelve months or earlier if information changes. The advertiser must report material changes immediately. The Portal may suspend or withdraw a badge without notice where evidence becomes unreliable, a complaint or official information raises concern, or re-verification is not completed.

Acceptable Use Policy

Offer and payment misuse

Users must not submit sham offers, manipulate views, impersonate a party, divert a transaction outside the Portal, change beneficiary details through informal communications, evade fees, launder funds or provide forged identity, authority, title or completion documents.

1. Permitted use

Users may use the Portal only for lawful property discovery, listing, communication, verification and approved transaction activity in accordance with their authority and the applicable contractual documents.

2. Prohibited conduct

  • fraud, impersonation, false identity, forged documents, unlawful discrimination or deceptive listings;
  • harassment, threats, defamatory or privacy-invasive content;
  • scraping, harvesting, bulk messaging, reverse engineering or circumventing access, ranking, payment or security controls;
  • uploading malicious code or testing vulnerabilities without written authorisation;
  • using another user’s contact or transaction data for unrelated solicitation;
  • manipulating reviews, enquiries, prices, availability, badges or platform metrics;
  • infringing copyright, trademarks, confidential information or database rights;
  • facilitating unlawful payments, bribery, money laundering, terrorism financing, sanctions evasion or tax fraud; and
  • encouraging users to disregard independent title and transaction checks.

3. Enforcement

The Portal may warn, remove content, limit functionality, preserve evidence, suspend or terminate accounts, reverse benefits, notify affected persons and cooperate with authorities. Measures will be proportionate to risk, urgency, repeat behaviour and applicable law. Users may appeal through the Complaints Policy unless doing so would prejudice safety or an investigation.

Fraud Prevention and User Safety Policy

Payment safety controls

Users must pay only through the authenticated transaction page into the designated escrow arrangement. Any change of beneficiary, escrow destination or release instruction must undergo enhanced verification. The Portal and escrow provider may pause a transaction where fraud, impersonation, title conflict, sanctions, source-of-funds concern or account takeover is suspected.

1. Safety position

Property fraud may involve impersonation, forged title documents, false agents, duplicate sales, pressure tactics or payment diversion. Portal checks reduce limited risks but cannot eliminate them.

2. User rules

  • Do not pay solely because a listing carries a badge.
  • Use only the payment instructions displayed within the authenticated transaction flow and verify changes independently.
  • Do not send funds to a personal or substituted account merely on a message or call.
  • Inspect the property and engage independent Nigerian counsel to investigate title and transaction documents.
  • Confirm the identity and authority of the owner, developer, landlord and agent.
  • Do not release balance consideration until agreed conditions and documentary checks are satisfied.
  • Report suspected impersonation, conflicting ownership, forged documents, pressure or payment diversion immediately.

3. Portal controls

The Company may apply identity/document checks, device and account monitoring, velocity limits, transaction holds by the licensed provider, enhanced review, callback verification, account restriction and evidence preservation. Controls are risk-based and may not be disclosed in full.

4. Reporting and response

Reports should include listing URL, account, payment reference, communications and supporting evidence. The Portal may restrict activity, notify the payment provider, contact counterparties, preserve logs and make lawful reports. It does not promise recovery of funds; users must promptly contact their bank/payment provider and law enforcement where appropriate.

5. No retaliation and false reports

Good-faith reporting is encouraged. Retaliation, intimidation or knowingly false reporting is prohibited and may lead to restriction or legal action.

Intellectual Property, User Content and Takedown Policy

Property-media warranty

Every advertiser warrants that it owns or is authorised to use property photographs, videos, plans, descriptions, logos and supporting documents, and grants the limited licence required to publish, promote, investigate and preserve the advertisement and transaction record.

1. Portal rights

The software, interface, branding, selection and arrangement of content, databases and original materials on 360 Propertii Realty are owned by or licensed to 360 Propertii Realty. No right is granted except the limited, revocable right to use the service lawfully.

2. User-content licence

The user retains ownership of lawful content it uploads but grants the Company a non-exclusive, worldwide, royalty-free licence, for the period necessary to operate and promote the service and preserve legal records, to host, reproduce, format, display, distribute, moderate and technically adapt that content. The user warrants it has all necessary rights and consents.

3. Restrictions

Users must not copy, scrape, republish, create competing databases from, remove notices from or commercially exploit Portal content without written permission or a lawful exception.

4. Takedown notice

A rights-holder should send identification and contact details; the protected work; the challenged URL/material; basis of ownership; good-faith statement; requested action; supporting evidence; and signature to the Contact Us facility.

5. Procedure

The Portal may acknowledge, request evidence, restrict access temporarily, notify the uploader, receive a response, restore or remove the material, preserve records and address repeat infringement. Takedown is an administrative risk-control step and not a final adjudication of rights. False or abusive notices may create liability.

Offers, Complaints and Dispute Resolution Policy

Offer submission and approval

A registered prospective purchaser may submit an offer through the Portal. The administrator may review identity, completeness, amount, conditions, payment readiness and fraud indicators before communicating the offer to the Advertising User. Administrative approval is not acceptance. Acceptance occurs only when the Advertising User accepts through the approved workflow or signs the applicable transaction document.

Offer status and communications

The Portal may label an offer pending, approved for communication, countered, accepted, rejected, expired, cancelled, disputed or completed. Communications outside the recorded workflow may be disregarded for administrative and escrow purposes.

Transaction complaints

An offer or escrow complaint must state the listing, offer, parties, amount, evidence and remedy sought. Pending review, the Portal may request the escrow provider to maintain a hold, but final dealing with funds remains subject to the escrow mandate, party agreement, mandatory law or binding order.

1. Scope

This Policy covers complaints about accounts, listings, verification, payments, refunds, privacy, intellectual property, discrimination, safety and customer support. Transaction disputes between users remain primarily their responsibility unless the Portal expressly undertook the disputed obligation.

2. Submission requirements

  • complainant’s name and verified contact;
  • account, listing and transaction references;
  • clear chronology, persons involved and remedy requested;
  • contracts, receipts, messages, screenshots and other evidence; and
  • any urgency, safety issue, court process or prior report.

3. Handling stages

  • Acknowledgement within two business days.
  • Triage for safety, fraud, privacy, payment or legal escalation.
  • Evidence preservation and interim restriction where proportionate.
  • Request for response from affected parties, ordinarily within five business days.
  • Reasoned outcome or status update ordinarily within fifteen business days, subject to complexity.
  • Internal appeal within seven days to a person not primarily responsible for the initial outcome.

4. Possible outcomes

Outcomes may include correction, removal, warning, verification withdrawal, account restriction, refund under the applicable payment terms, referral to the payment provider, restoration of content, no action, or lawful referral to a regulator or authority.

5. External rights

Nothing prevents a user from exercising non-excludable statutory rights or approaching an applicable regulator, court or law-enforcement authority. Contractual mediation, arbitration or jurisdiction provisions remain governed by the applicable agreement.

Transaction Payment, Agency Fee, Cancellation and Refund Terms

Core commercial terms

ItemAgreed position
Agency Fee3% of the Transaction Price, earned and deducted on Completion.
Cancellation Fee3% of the Transaction Price, payable by the party whose withdrawal/default causes cancellation, subject to stated exceptions.
Secure holdSegregated safeguarded arrangement with the Escrow Provider identified on the transaction page.
ReleaseOnly after completion conditions and authenticated instructions.
DisputeRelevant funds remain held pending agreement or binding determination.
Tax/provider chargesDisclosed separately and deducted only where authorised.

Secure payment structure

All Purchase Funds shall be paid into the segregated escrow account or safeguarded payment arrangement maintained with the Escrow Provider identified on the transaction page under a written mandate. Legal title to Purchase Funds does not pass to 360 Propertii Realty. The funds shall not be commingled with operating money, pledged, invested, borrowed, attached for the Portal’s debts or released except under the transaction order, joint instruction, provider terms, mandatory law or binding order.

Agency Fee

Upon Completion, 360 Propertii Realty earns an Agency Fee equal to 3% of the Transaction Price, plus applicable tax where lawfully chargeable. The parties irrevocably authorise the escrow provider to deduct the Agency Fee and authorised provider charges and remit the net balance to the Advertising User or other lawful payee. “Completion” means satisfaction or waiver of the stated completion conditions and lawful authorisation of release, whether the parties execute or conclude through the Portal or, in breach of these Terms, outside it following a Portal introduction.

Cancellation Fee

Where an accepted transaction is cancelled because a party unilaterally withdraws, repudiates, fails to pay, fails to provide required documents, refuses to complete or otherwise defaults, that party shall pay 360 Propertii Realty a Cancellation Fee equal to 3% of the Transaction Price. The fee may be deducted from sums otherwise refundable to that party only to the extent authorised by the escrow mandate and applicable law. It is intended to compensate the Portal for introduction, administration, compliance, opportunity and transaction costs, without prejudice to separately proven rights of the innocent party.

Exceptions to Cancellation Fee

The Cancellation Fee does not ordinarily apply where: the parties mutually cancel before material transaction work and the Portal agrees in writing; a condition precedent fails without fault; title/authority is materially defective or misrepresented by the Advertising User; the transaction becomes unlawful; the Portal or escrow provider cannot lawfully proceed; or mandatory law requires a refund without the fee. If responsibility is disputed, the relevant amount remains held until agreement or binding determination.

Release conditions

Purchase Funds shall be released only after the transaction order’s conditions are evidenced, including as applicable executed conveyancing/tenancy documents, identity and authority checks, agreed title-search outcome, satisfaction of conditions precedent, possession/handover confirmation, payment of taxes/charges allocated to the parties, and authenticated release instructions.

Refund mechanics

Approved refunds shall be returned to the original lawful funding source, less only disclosed and legally deductible amounts, within ten business days after the escrow provider receives complete instructions and compliance clearance. A refund may be delayed by chargeback, investigation, court order, sanctions, AML/CFT or source-of-funds requirements.

Disputed funds

No administrator may finally adjudicate title or confiscate disputed funds. The escrow provider shall continue the hold, return funds, release funds, pay into court or act otherwise only under the mandate, joint settlement, arbitral award, court order or applicable law.

1. Important structure

360 Propertii Realty facilitates transaction payments through the Escrow Provider identified on the transaction page. Unless a separate signed stakeholder agreement expressly states otherwise, 360 Propertii Realty does not accept deposits as beneficial owner, does not mix transaction funds with operating funds, and does not itself provide a regulated payment service. The provider’s terms and regulatory status apply in addition to these Terms.

2. Transaction order

Before payment, the transaction page or signed order must identify the property, payer, intended recipient, amount, purpose, applicable fees/tax, provider, release conditions, cancellation/refund conditions, evidence required, long-stop date and dispute channel. No generic website term substitutes for transaction-specific instructions.

3. Authorised payment

A payment is recognised only when made through the displayed authenticated flow and confirmed by the provider. Users must independently verify any requested change of beneficiary or bank details. Cash and off-platform transfers are at the user’s risk and may not be protected by these Terms.

4. Holding and release

  • Funds are held by the provider under its licence and the transaction instruction.
  • Release occurs only upon satisfaction or waiver of the stated documentary/event conditions and any required approvals.
  • The Portal may transmit instructions or evidence but does not determine disputed title unless separately retained as legal counsel.
  • The provider may delay, reject, freeze or report activity to comply with law, fraud controls, sanctions, court orders or regulatory directions.

5. Cancellation and refunds

A refund is available only where the transaction order, provider terms or mandatory law permits it. Listing/subscription fees, verification fees, provider charges and third-party professional costs are distinct from transaction principal and may be non-refundable once the service has begun, subject to mandatory rights. Approved refunds must ordinarily return to the original funding source after deductions expressly authorised by law or contract.

6. Transaction disputes

A disputing party must notify the Portal and provider promptly with supporting evidence. Pending resolution, the provider may continue to hold undistributed funds where authorised. The Portal may facilitate settlement but does not adjudicate ownership or title. If parties do not agree, funds may remain held, be paid into court, or be dealt with under the signed stakeholder arrangement, provider terms or binding order.

7. Chargebacks and reversals

Users must not initiate a dishonest or duplicative chargeback. A lawful chargeback, bank reversal or provider adjustment may reverse a credit or settlement. The responsible party remains liable for amounts properly due, investigation costs and losses caused by its breach, subject to law.

8. AML, identity and source of funds

The Company/provider may require identity, beneficial ownership, authority, source-of-funds, transaction-purpose and supporting property documents. Failure, inconsistency or legal restriction may result in rejection, delay, report or refund to the lawful source where permitted.

9. No title guarantee

Acceptance, holding or release of money does not prove ownership, good title, planning compliance, physical condition or transaction enforceability. Each party must obtain independent professional advice.

Marketing Communications Consent Notice

Transaction communications

Consent is not required for service messages necessary to administer registration, advertisements, offers, escrow, fees, refunds, security and complaints. Promotional email, SMS, WhatsApp or profiling must be separately consented to where required and may be withdrawn without stopping necessary transaction communications.

1. Choice

Marketing consent must be optional, specific and separate from acceptance of service terms. Account creation, listing or payment must not be made conditional on unnecessary marketing consent.

2. Proposed checkbox wording

“I agree that 360 Propertii Realty may use my name, contact details, saved searches, stated preferences and Portal interactions to send me property alerts, newsletters, promotions and partner offers by the channels I select. I understand that I may withdraw consent at any time without affecting the service I have already requested.”

3. Channel controls

  • Email: no option is preselected.
  • SMS: no option is preselected.
  • WhatsApp: no option is preselected.
  • Telephone: no option is preselected.
  • Personalised advertising/profiling where consent is required: no option is preselected.

4. Evidence and withdrawal

The Company must record the wording/version, user, date/time, channel, source and withdrawal. Every message must identify the sender and provide a functional, easy opt-out. Withdrawal should be propagated promptly, subject to a minimal suppression record used to honour the choice.
